The Ministry of Education, Culture and Sport informs that the access and use of Insignias INTEF (hereinafter "the badge backpack", “the backpack”, “us” or “we”), in the domain educalab.es and all subdomains and directories included under it, as well as the services and contents that may be obtained through it, are subject to the terms that are detailed in this Legal Disclaimer, independently of that fact that access to any of such services or contents may require the acceptance of additional conditions.

Therefore, if you do not agree with the considerations detailed in this legal disclaimer, please do not use the badge backpack; otherwise, any use made of it or of its services and contents included therein will imply your acceptance of the legal disclaimer contained in this text. The terms and conditions contained in this disclaimer may vary, so we invite you to check these terms when you visit the backpack again.

The Ministry of Education, Culture and Sport reserves the right, at any time and without previous notification to users, to modify, extend or temporarily suspend the presentation, configuration, technical specifications and services of the backpack, as well as to make changes concerning the update, correction, modification, addition or deletion of the contents of the backpack or its design. The contents and services offered by the backpack are updated periodically. As the information on updates is not immediate, we suggest that you always check the validity and accuracy of the information, services and contents included in the backpack.

The information obtained through the backpack, as well as the answers to the questions submitted in its contact forms, fulfils a function of general information and attention to the citizen in the terms established in article 4 of Royal Decree 208/1996 of February 9th, which regulates the services of administrative information and attention to the citizen. Consequently, in no case binding legal effect may be derived.

Intellectual and Industrial Property Rights

All the contents of the backpack, unless expressly stated otherwise, are published under the Creative Commons Attribution-Share Alike 4.0 International (CC BY-SA 4.0) license and, therefore, the rights contained in this license are granted, as long as you accept the terms and conditions of the license.

The Ministry of Education, Culture and Sport declares respect for the intellectual and industrial property rights of third parties. Therefore, if you believe that the backpack may be violating your rights, please contact the Ministry of Education, Culture and Sport.

Protection of personal data and privacy

The General Directorate for Territorial Evaluation and Cooperation, Training and Universities of the Ministry of Education, Culture and Sport is the responsible entity for the data file generated with the personal data supplied by users of the backpack.

According to Law 15/1999 of December 13th Protection of Personal Data, this Department agrees to comply with its obligation of confidentiality relating to personal data and the duty to keep this data as confidential. For these purposes, we will take the necessary measures to avoid its alteration, loss, treatment or unauthorized access.

The Ministry of Education, Culture and Sports maintain the level of protection of personal data according to the Royal Decree 1720/2007 of 21 December, approved in the Regulation implementing Organic Law 15/1999, of 13 December, for the protection of personal data, and has established all the technical measures within its extent to avoid, misuse, alteration, unauthorized access and theft of data provided by users.

No personal data are collected from users without their knowledge, nor are they shared with third parties. The collection and automated treatment of personal data have the purpose of management, provision, extension and improvement of the services requested at any time by the user and the follow-up of queries raised by users. In order to offer the best service and easy use of the website, we analyse the number of pages visited, the number of visits, as well as the activity of visitors and their frequency of use.

Users may at any time exercise their rights to access, rectify, cancel and oppose their data compiled and filed, by requesting it by any means which tracks dispatch and reception. Requests must be sent to the National Institute of Educational Technologies and Teacher Training, C / Torrelaguna 58, 28027 Madrid (Spain), an institute dependent on the Directorate General for Territorial Evaluation and Cooperation.

The service Insignias INTEF provides contains links to third-party websites, whose privacy policies are unaffiliated to the backpack. By accessing such websites you can decide whether to accept their privacy and cookies policies. In general, if you browse Internet you can accept or reject third party cookies from your browser settings.

The Ministry of Education, Culture and Sport reserve the right to modify this Privacy Policy in order to adapt it to the new legislation, jurisprudence or interpretation of the Spanish Agency for Data Protection. In this case, the Ministry of Education, Culture and Sports will announce such changes, indicating clearly and in advance the modifications made, and requesting, if necessary, their acceptance of the aforementioned changes.

In compliance with the provisions of article 5 of the LOPD, it is informed that personal data, collected directly from the user through the different resources available on the backpack, will be treated confidentially and will be incorporated into the corresponding files owned by Insignias INTEF, with the purposes that are detailed in the General Data Protection Registry and not being used for incompatible purposes. The data collected may be transferred in the cases provided, for each file, into this Registry.

Those users affected can exercise their rights of access, rectification, cancellation and opposition upon the National Institute of Educational Technologies and Teacher Training, writing to its address at Torrelaguna, 58, 28027 Madrid (Spain), or via email to formacionenred@mecd.es.

Applicable Law and Jurisdiction

The applicable law in the event of a dispute or conflict over interpretation of the terms comprising this Legal Disclaimer, as well as any question related to the services of this backpack, will be Spanish law.

For the resolution of any conflict that may arise on the occasion of visiting the backpack or the use of the services offered in it, the Ministry of Education, Culture and Sport and the user agree to submit to the Courts in the locality of residence of the user, as long as such locality is within Spanish territory, and following the civil or administrative claims that in accordance with the provisions of Law 30/1992, of November 26, on the Legal Regime of Public Administrations and Common Administrative Procedure, are appropriate.

Reuse of data

The reuse of the data sets available in the backpack will be made by the users at their own risk, and they will be exclusively held responsible before third parties for damages that may arise from it.

The Ministry of Education, Culture and Sport shall not be held responsible for the use made of its information by third parties, or for damages suffered, or for economic losses that, directly or indirectly, may cause economic, material or data damages, derived from used or reused information.

The Ministry of Education, Culture and Sport does not guarantee the continuity of the documents of the backpack nor assume any liability or responsibility for any errors or omissions in the content of the web site, any failures, delays, or interruptions.

Hyperlinks

The Ministry of Education, Culture and Sport provides access to other web pages that we consider may be of interest to you through links in the backpack. The purpose of such links is solely to provide you with a set of resources in Internet that may interest you. However, these pages do not belong to the backpack, nor its contents are reviewed and, therefore, can not be held responsible for them, for the operation of the linked page or any possible damages that may arise from access or use of it. The user assumes under its sole responsibility the consequences, damages or actions that could derive from access to the website of the link.

Users who intend to establish a hyperlink between their website and Insignias INTEF should take into account the following:

What are cookies?

A cookie is a file that will be downloaded on your computer after browsing in certain web pages. Cookies allow the web site to, among other things, store and retrieve information about a user’s browsing habits or his/her device. Insignias INTEF does not use cookies to collect information from users, nor does it store IP addresses. The website only uses personalized cookies, cookies to remember users' sessions or with technical purposes (those that allow the user to navigate through the website and the use of the different options and services that exist in it).

  • Technical cookies: Cookies which allow the user to navigate a website, a platform or app and the use of the different options or services provided. For instance, control the traffic and data communication, identifying the session, access some restricted places, remember the elements of an order, sign in or register in an event, use security elements during navigation, store content for video or audio dissemination or share content through social networks.

  • User-interface customisation cookies: Cookies which allow the user to access some general predefined features based on a series of criteria in the user’s terminal equipment such as language, browser or regional preferences.

  • Analysis cookies: Cookies which are either analysed internally or by a third-party that will allow us to assess the number of users and so, will enable us to measure and statistically analyse our users’ behaviour of the services offered. In order to do that, navigation in our website is analysed so as to improve the products and service we provide.
